Who we are

Moxi is operated by Artisan Deli Market Limited, a company registered in England and Wales with company number 13546629, registered office Preston Park House, South Road, Brighton, East Sussex, BN1 6SB. Artisan Deli Market Limited is the contracting party for these terms.

The service

Moxi gives artists and creators a hosted page where fans can listen, follow, get tickets and join their list, with audience analytics. The Moxi app is a mobile version of the same artist dashboard. We may add, change or remove features over time.

Your account

You are responsible for your account and for the content you publish. Do not publish anything unlawful, infringing, or that you do not have the right to use. You can delete your account at any time from the dashboard, under Settings then Account, or by contacting us.

Your fans’ data (important)

When fans join your list, you are the controller of that data and Moxi processes it for you. You confirm that:

• You have the right to collect and use your fans’ data and will comply with applicable privacy laws.
• You provide any notice or consent your fans are entitled to, and you honour their requests to opt out or be deleted.
• When you connect Meta (or another ad platform), you authorise Moxi to send your fans’ events to that platform on your behalf, and you agree to that platform’s business tool terms.

Acceptable use

Do not misuse the service, attempt to break its security, send spam, or use it to harass or deceive. We may suspend accounts that do.

Made products (Moxi Made)

If you design and order products through Moxi Made, you are instructing us to manufacture goods to your specification. You confirm that:

• You own or have the rights to the artwork, text and marks you upload or create, and to have them printed and sold.
• You will not create counterfeits or use another party’s brand, logo or trademarked characters without permission. This is our first and firmest rule, and orders that break it are cancelled.
• We manufacture on your instruction and you are responsible for the content of your designs. We review designs and may refuse or hold any order we believe breaks these terms or the law.
• Samples are made for you. Selling made products to fans is subject to any additional terms shown to you at the time you publish.

Disclaimer and liability

Moxi is provided “as is”. To the extent permitted by law, we are not liable for indirect or consequential loss, and our total liability is limited to the amount you paid us in the previous 12 months.

Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, for fraud, or for your rights as a consumer.

Termination

You can stop using Moxi at any time. We may suspend or end access for a breach of these terms.

Using the Moxi app from the Apple App Store

If you download or use the Moxi app from the Apple App Store, the following also applies, in addition to the terms above:

• Apple’s standard licence. These terms are between you and Artisan Deli Market Limited, not Apple. To the extent they do not cover the following, Apple’s standard end user licence agreement applies instead: maintenance and support, warranties, product claims, intellectual property claims, and contact details. You can read it at apple.com/legal/internet-services/itunes/dev/stdeula.
• Scope of licence. Your licence to use the app is a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Support and claims. Apple has no obligation to provide any support for the app, and is not responsible for any product warranties or claims. Any such claims are the sole responsibility of Artisan Deli Market Limited.
• Apple as third party beneficiary. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you.
• Export. You confirm you are not located in a country subject to a US Government embargo or designated as terrorist supporting, and that you are not on any US Government list of prohibited or restricted parties.

Governing law

These terms are governed by the laws of England and Wales.
